3. Service Description
We provide pension-related legal support in Thailand, including rights clarification, mediation, negotiation, and ongoing stewardship for complex matters. Services are provided primarily in Bangkok and are offered in English and Thai. The website is informational in nature; it does not constitute legal advice.
Service availability is subject to appointment scheduling and practitioner capacity. We reserve the right to decline an engagement where a conflict of interest or other professional obligation applies.
4. Enquiries and Website Use
Submission of the contact form on this website constitutes an enquiry only. No legal relationship is formed until both parties have agreed in writing to a formal engagement. You agree not to use this website for any unlawful purpose and not to submit false or misleading information through the contact form.
5. Service Delivery Terms
- Scope: The scope of each engagement is agreed in writing before work begins. Work outside the agreed scope requires separate written agreement.
- Timelines: Indicative timelines are provided at the outset, but legal matters may be affected by factors outside our control. We will inform you promptly of any material change.
- Updates: For ongoing engagements, we provide regular updates without requiring you to request them.
- Written records: Key decisions and meeting summaries are provided in writing as standard.
- Language: Services are delivered in English by default; Thai language is available on request.
6. Fees and Payment
All fees are stated in Thai Baht (฿) and are communicated clearly before work begins. Published fees represent the starting point for each service; the full cost of longer engagements is agreed in writing before proceeding.
- Payment is due within 7 days of invoice unless otherwise agreed in writing
- Accepted payment methods will be confirmed at engagement
- Fees for work already performed are not refundable
- Fees for services not yet commenced may be refunded at our discretion, subject to any reasonable administrative costs
7. Confidentiality
We treat all information shared with us in the course of an engagement as strictly confidential in accordance with Thai legal professional obligations. Information is not disclosed to third parties except where necessary for the conduct of your matter and with your prior knowledge, or where required by law.
8. Intellectual Property
All content on this website — including text, structure, and design — is the property of Yutthitham Bhakdi. You may not reproduce, distribute, or use any part of it without our written consent. Written summaries and documents produced specifically for your engagement become yours to use for the purposes for which they were prepared.
9. Disclaimers
The information on this website is provided for general informational purposes and does not constitute legal advice. No reliance should be placed on website content as a substitute for professional legal advice specific to your circumstances.
Legal outcomes cannot be predicted with certainty. We do not make representations about the likely outcome of any matter. Advice given reflects professional judgment based on the information available at the time it is provided.
10. Limitation of Liability
To the extent permitted by Thai law, our liability in connection with any engagement is limited to the amount of fees paid by you for that engagement. We are not liable for indirect, consequential, or incidental losses arising from the use of this website or the conduct of an engagement.
This limitation does not apply to liability arising from professional negligence, fraud, or any matter that cannot be excluded under Thai law.
11. Termination
Either party may terminate a formal engagement by giving written notice. You are responsible for fees incurred up to the date of termination. We reserve the right to terminate an engagement where continued representation would conflict with professional obligations, in which case reasonable notice will be provided.
Sections covering confidentiality, intellectual property, fees, and dispute resolution survive termination.
12. Dispute Resolution
These terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, we encourage you to contact us first to attempt an informal resolution.
Disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the Thai courts in Bangkok. Where a client wishes to raise a complaint about professional conduct, this may also be directed to the Lawyers Council of Thailand.
13. General Provisions
- Entire agreement: These terms, together with any written engagement agreement, constitute the entire agreement between the parties.
- Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
- Waiver: Failure to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign obligations under these terms without our written consent.
14. Changes to These Terms
We may update these terms periodically. The revised date at the top of this page reflects the most recent version. Your continued use of this website after a material change constitutes acceptance of the updated terms.
